What A Roofer Can And Cannot Do Under Florida Law

Florida Statute 626.854 restricts who can adjust or negotiate claims on your behalf. A licensed public adjuster can. A licensed attorney can. A roofing contractor cannot - and any roofer who tells you otherwise is putting both their license and your claim at risk.

The Documentation Sarge Provides

What To Do When You Have Damage

  1. Take your own photos immediately - from the ground, from a window, of any interior damage
  2. Contact your carrier to report the loss and get a claim number
  3. Call Sarge for an inspection - we'll document what we see and give you the packet above
  4. Decide your representation - handle the claim yourself, use a public adjuster, or consult an attorney. That's your choice.
  5. Get the work done with the roofer of your choice once the claim is resolved

You can absolutely use a different roofer for the actual repair. Sarge inspecting and documenting your damage creates zero obligation to use Sarge for the work.

The Red Flags Sarge Will Not Cross

"We Work With All Insurance Companies"

What that often means is the roofer plans to negotiate with your carrier on your behalf. Under Florida law, they cannot. If they're saying it, they're either misrepresenting what they do or they're operating outside their license.

"We'll Get Your Claim Approved"

No Florida contractor can promise a claim outcome. The carrier and the adjuster decide that based on your policy and the documented damage. A promise of approval is a sales pitch, not a fact.

"Just Sign This AOB And We Handle Everything"

Assignment of Benefits gives the contractor your claim rights. Florida limited AOBs in 2019 (HB 7065) and again in 2022 because homeowners were getting trapped in contracts they couldn't escape. We never use AOBs.

"We'll Waive Your Deductible"

This is a felony in Florida under F.S. 489.147. Any contractor who quotes a deductible waiver is asking you to participate in insurance fraud. Report them to DBPR.

When You Should Hire A Public Adjuster Or Attorney

Some claims genuinely benefit from professional representation. A licensed Florida public adjuster represents you and can negotiate with your carrier. An attorney can do the same and can also pursue bad-faith claims if the carrier is operating outside their obligations.
